§ 1 General Provisions & Application
a) These Terms and Conditions apply to all services provided by Parently through the website Parently.se.
b) Scope of Application: These General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order by the customer apply to all orders placed through the online shop www.parently.se.
c) By using our website, placing an order, or renting products from Parently, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with any other policies referenced herein.
d) Parently reserves the right to update or amend these Terms and Conditions at any time. We will notify users of any changes by updating the terms on our website. Continued use of the website following such changes will be deemed acceptance of the new terms.
§ 2 Service Definition
2.1 Conclusion of the Contract
a) The mere presentation of rental and purchase items in the online shop does not constitute a legally binding offer for the conclusion of a rental and/or purchase contract. The product range in the online shop is non-binding and subject to change. By clicking the "Order Now" button, the customer submits a binding offer to conclude a rental and/or purchase contract, provided they have previously agreed to these terms and conditions by checking the designated box and have acknowledged the cancellation policy.
b) The receipt of the customer’s order is confirmed immediately by email; however, this order confirmation does not yet constitute acceptance of the offer by Parently. It serves merely to inform the customer of the receipt of the order and contains the legally required information about Parently as a potential rental and/or purchase contract partner, along with these terms and conditions and the cancellation policy.
c) The acceptance of the contract by Parently occurs through a separate order confirmation via email. If a rental and/or purchase item is not available or not available in the corresponding version, the customer will receive a notification email within 3 business days.
2.2 Prices
All prices for rental are stated in SEK, including VAT, unless otherwise specifically indicated. Delivery and return fees apply according to the information provided on the website. Parently reserves the right to annually adjust the price for ongoing rentals in accordance with the consumer price index (CPI).
2.3 Rental Period
The rental period begins on the delivery date selected by the customer at the time of order placement, or, at the latest, on the actual date of delivery if delivery occurs after the selected date. If a pickup has been agreed, it is the customer's responsibility to collect the rental item on time. In the event of a delivery delay caused by Parently, the rental period will commence on the date the product is actually delivered. The rental continues for the agreed minimum duration and is automatically extended by one additional month at a time unless the rental agreement is properly terminated in accordance with Parentlys terms and conditions.
2.4 Right of Withdrawal
We differentiate between short-term rental products (up to 2 months rental period or products marked "short term") and long-term rental products (more than 2 months rental period):
1. Right of Withdrawal for Short-Term Rental Products (up to 2 months rental period or products marked "short term"):
a) If you cancel at least 6 days before the scheduled delivery date, you are entitled to a 100% refund.
b) If you cancel within 5 days of the scheduled delivery date or return the product earlier than agreed, no refund will be issued. This is because short-term rental products are reserved exclusively for you for the ordered period and are limited in availability.
2. Right of Withdrawal for Long-Term Rental Products (more than 2 months rental period):
a) If you cancel before the product has been picked up by our logistics partner (normally at least 6 days before the delivery date), you are entitled to a 100% refund.
b) If you cancel your purchase after the product has been shipped by us / collected by our logistics partner (e.g. DHL) but before you have received or collected the product, you will receive a refund minus a fee of 299 SEK per package. This fee covers the costs charged by our logistics partner for handling and returns. If the package circumference exceeds 300 cm, the return shipping cost may increase significantly depending on the size and weight of the package(s), and can be up to 2000 SEK, which we then need to charge extra.
c) The rental service is deemed to have commenced once the product has been received or collected by the customer. The customer is entitled to withdraw from the agreement within 14 days of receipt. In the event of withdrawal, the customer will be charged the rental fee for the first three (3) months (calculated based on the rental fee applicable to the 3+ month rental duration) in order to cover costs already incurred (including, but not limited to, refurbishment and cleaning). In addition, the costs of delivery (SEK 90 per order) and return (SEK 90 per return label) shall be borne by the customer. If the package circumference exceeds 300 cm, the return shipping cost may increase significantly depending on the size and weight of the package(s), and can be up to 2000 SEK, which we then need to charge extra. You, as the customer, are responsible for the goods until they reach us, including during transport. This responsibility includes ensuring that the product is not damaged or lost during the return shipment.
2.5 Contract Termination
a) Long-Term Rentals (more than 2 months)
Long-term rentals are subject to a minimum rental period as specified on the Website, unless otherwise expressly agreed. After the minimum period, the rental agreement is automatically extended by one additional month at a time, unless the customer terminates the contract at least 14 days before the end of the current rental period and returns the product no later than 3 days after the rental period expires. The customer is responsible for providing sufficient proof of the timely return. Contract termination must be carried out via the Self Service Portal.
b) Short-Term Rentals (up to 2 months or products marked “short term”)
Short-term rentals have a fixed rental duration and automatically expire at the end of the agreed period, provided the product is returned on time.
- If the product is returned in person, it must be received by Parently no later than the last day of the rental period.
- If the product is returned via shipping, it must be posted latest on the last day of the rental period at the latest and must arrive no later than 3 days after the rental period ends.
If these conditions are not met, you will be charged the difference to the next applicable rental period. It is the customer’s responsibility to ensure timely return and to retain proof of return.
Note: The following paragraphs are valid for both, long and short term rentals:
1) The customer must either ship the item or return it in person to the location designated by Parently so that it is received no later than 3 days after the rental period ends. If the item is not shipped or returned in time, the rental period will automatically be extended by a) one additional month for long term rentals, or b) until the item is returned, for short term rentals.
2) The customer remains responsible for the care of the item until it is returned. If the item is not returned on time, rental fees will continue to accrue.
3) Upon return, the rental item must be in good condition, accounting for normal wear and tear, and must include all originally provided components. Washing is not required.
4) The item is considered returned only once it has been received at Parently’s warehouse and registered as returned in the system.
2.6 Non-Payment
If payment fails, Parently will attempt to process it two additional times. Each attempt will be accompanied by a reminder email with the option to manually transfer the outstanding fee to Parently's bank account. If payment remains unsettled after these reminders, Parently reserves the right to charge collection costs of 180 SEK per collection (according to Section 5 of the Debt Recovery Act), a payment reminder fee of 60 SEK per overdue invoice, and will request the immediate return of the item.
Parently reserves the right to transfer unpaid invoices to third-party debt collection agencies.
Failure to return the unpaid item within 7 days may result in legal action. Furthermore, Parently reserves the right to charge: a) for a rented new product, the full retail price as listed by the brand, or b) for a rented "pre-loved" product, the retail price listed by the brand minus a 15% "pre-loved" discount.
2.7 Theft and Loss
a) In the event of loss or theft of the rented item, the customer must notify Parently by email within 24 hours of discovery and report the incident to the police. A copy of the official police report must be submitted to Parently without delay.
b) In such cases, the customer is required to compensate Parently for the loss based on the current replacement value of the rented item, as determined by the official manufacturer price list.
c) Rental fees will continue to be charged until Parently receives the official police report and the incident is formally registered.
d) Upon receipt of the police report, Parently may offer a replacement item for a one-time fee based on the official manufacturer's sales price. If the item has been confiscated, seized, or has otherwise come into the possession of a third party, the customer must inform Parently immediately.
2.8 Availability
All rental agreements are subject to availability. Parently does not guarantee the availability of specific products at any given time.
§ 3 Services and Support from Parently when Concluding a Rental Agreement
a) In the event of the conclusion of a rental agreement, the rental item—potentially configured according to the customer's preferences—will be shipped to the customer and provided for the contractually agreed duration of the rental period. Parently will make every effort to deliver the item on the delivery date requested by the customer.
b) The rental item is provided to the customer on a rental basis only. Parently remains the owner of the rental item, and ownership is not transferred to the customer.
c) The scope of delivery for the rental item is determined by the product description of the item provided in the online shop.
d) Parently is responsible for the maintenance and repair of the rental item to the extent that the wear and tear of the rental item is due to its intended use by the customer (hereafter referred to as a "service case"). Service due to willful or grossly negligent damage to the rental item, is excluded.
e) Parently will strive to maintain, repair, or service the rental item within 48 hours after the customer has contacted Parently by phone, email, or chat. The customer should provide appropriate evidence of the required maintenance or repair in their service request.
f) If the customer requests service not due to a service case, Parently has the right to charge a fee as agreed with the customer.
g) If Parently replaces a rental item, the item to be exchanged must be immediately handed over or returned by the customer to Parently.
§ 4 Usage of rental products & product care requirements
The Customer is required to observe and comply with the following terms throughout the rental period:
a) The Customer has a general duty of care for the rented item and must, with reasonable diligence, prevent deterioration beyond normal wear and tear. This includes the obligation to maintain the item through regular cleaning and careful handling in order to avoid abnormal wear, damage, or deterioration due to negligence. The item must be treated as if it were the Customer’s own, so that it remains in reusable condition for future families.
b) The Customer may use the rented item only in accordance with the rental agreement, any accompanying instructions, and for its intended purposes.
c) The rented item is provided in its current condition and may show signs of previous use, resulting in normal wear and tear.
d) Traveling with the rented item is permitted. However, the Customer must ensure the item is stored securely during travel to prevent damage. If secure storage is not possible, the item must be carried as hand luggage.
e) The Customer must handle and store the rented item in a manner that prevents damage, unauthorized use, or theft. Parently covers the cost of repairs or spare parts if the damage occurs through normal usage.
f) The Customer may not sublease, rent out, or otherwise transfer the rented item to another party without prior written permission from Parently.
g) The Customer may not modify, remove, or tamper with any identifying labels, tags, or markings on the rented item. Any damage to or illegibility of such markings must be reported to Parently without delay.
h) The rented item may not be incorporated into any real estate or movable property.
i) The Customer is not permitted to pledge, assign, transfer, or otherwise grant rights to the rented item to third parties.
j) In the event of negligent use, loss, theft, or damage to the rented item or any of its components, the Customer is liable to compensate Parently for the resulting damage or loss.
§ 5 Defects, Damages, and Damage Coverage
a) Upon receipt of the rented item, the Customer must inspect it for any visible defects or damages. Any such issues must be reported to Parently via email within seven (7) days of delivery. If no report is submitted within this timeframe, the item will be deemed to have been received in the expected condition.
b) The Customer is required to report any damage to the rented item to Parently by email as soon as possible, and no later than within two (2) days after the damage has occurred or become known. The report must include a clear photo of the damage.
c) In the event of damage or excessive wear beyond what is considered normal use, Parently reserves the right to charge the Customer for the costs of repair or replacement, based on Parently’s assessment. The Customer may optionally purchase damage coverage via the Website to limit liability for such instances.
d) If the rented item is a car seat and it is involved in a car accident, the Customer must notify Parently immediately. A replacement seat will be provided, and Parently will issue an invoice to enable the Customer to recover the cost from their car insurance provider.
e) Any legal claims the Customer may have against Parently arising from damages attributable to Parently must be submitted within one (1) year from the date the claim became due. Claims submitted after this period will be considered void.
§ 6 Extraordinary Termination (applies only to rental agreements with the customer)
a) Both contractual parties are entitled to terminate the rental agreement without notice if an important reason exists, insofar as the other party has breached its contractual obligations to such a significant extent that it is unreasonable for the other party to continue the rental agreement.
b) An important reason for Parently to terminate includes (but is not limited to) the following:
• The customer is in arrears with the payment of two consecutive monthly rents or an amount equivalent to at least two monthly rents.
• Enforcement measures are taken against the customer and/or there are registered entries in the debtor's register.
• The customer uses the rental item in a significantly non-contractual manner despite warnings from Parently.
• The customer repeatedly makes unjustified use of the offered service under §3 despite warnings from Parently, particularly in cases where no significant wear of the rental item exists or where wear occurs due to improper use/deliberate damage and/or destruction.
§ 7 Special Conditions for the Conclusion of Purchase Contracts with Parently
a) Parently marks items for sale in the online shop as "purchase products," for which the customer can submit an offer to conclude a purchase contract at the specified purchase price.
b) The statutory provisions apply with regard to liability for material defects (warranty).
c) Until full payment of the purchased item has been made, ownership remains with Parently (retention of title).
d) Parently is entitled to make partial deliveries (items being out of stock or shipped from different locations), provided this is reasonable for the customer and if the customer's interest in the entire contract has not been nullified by the partial delay or partial delivery.
§ 8 User Accounts and Registration
a) Customers must create a user account to place orders and access our services. You are responsible for maintaining the confidentiality of your account information.
b) You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
c) Parently reserves the right to suspend or terminate accounts if false, inaccurate, or incomplete information is provided, or if any unlawful or fraudulent activity is detected.
§ 9 Payments and Credit Check
a) When placing the order the rental fees for the first rental month and the required shipping costs are due.
b) All upcoming (recurring) rental fees are due monthly in advance for the upcoming month.
c) Parently accepts payments through various payment methods as displayed on the website.
d) Credit Checks: During the order process, Parently may perform a credit check using third-party providers such as CRIF, Creditsafe, or Upplysning Checknode AB. To enable this check, the Customer may be required to provide their national (Swedish, Danish) personal identification number (personnummer) and date of birth. If the Customer does not have a personal ID number, they may enter “noID” to initiate a manual credit review.
A positive credit check is required for the rental agreement to become valid. The number of credit checks performed does not affect the Customer’s creditworthiness, rating, or future credit assessments. Parently does not store or publish any credit information retrieved during this process.
If a Customer attempts to bypass a negative credit check by making multiple purchase attempts, Parently reserves the right to charge a fee of 30 SEK per credit check to cover associated costs, along with a one-time administration fee of 300 SEK.
e) 9.5 By providing payment details, you confirm that you are authorized to use the chosen payment method and that all payment information is accurate.
f) Parently reserves the right to delay or refuse any orders due to security concerns or payment issues.
g) If payment is delayed, interest on arrears of 8 percent will be charged from the date the monthly payment was due.
h) Parently reserves the right to charge for issued payment reminders and delay fees according to Parently's current policy at any given time.
§ 10 Rental Deposit
Parently reserves the right to request a rental deposit of up to 50% of the new retail price of the product before accepting a rental agreement initiated by the Customer. This deposit may be required to secure the rental and will be clearly communicated during the checkout process.
The deposit may be withheld, in full or in part, to cover:
• Outstanding or unpaid rental invoices, and/or
• Charges incurred due to non-returned or damaged products as outlined in these Terms and Conditions.
Any remaining deposit amount will be refunded to the Customer once all contractual obligations have been fulfilled and the rental item has been returned in accordance with Parently’s return policy.
§ 11 Delivery, Notice Period and Returns
a) Parently delivers rental items to addresses within Sweden and Denmark. Delivery times and charges may vary based on the location and specific product ordered.
b) Delivery and Limitation of Liability: Parently cannot guarantee that delivery will occur exactly on the requested or selected date. Delivery times may be affected by external factors and our logistics partners, which means delays can occur. No right to compensation, price reduction, or damages applies in the event of delayed delivery outside of Parently’s control.
c) If the customer selects delivery to a service point, Parently reserves the right to charge a fee of SEK 199 for deliveries that are not collected within the specified time frame.
d) Customers must inspect items upon delivery and notify Parently within 24 hours of any defects or issues.
e) At the end of the rental period, customers must return the items in their original packaging, with all components as listed in the manufacturer's parts list.
f) Parently provides a self-print return label for the items. It is the customer’s responsibility to follow the return instructions provided and ensure items are returned on time.
g) Notice Period: Cancellation of the subscription must be made no later than 7 days before the desired end date via the customer area. This ensures that you as a customer have enough time to return the product on time, and that we can plan for the next rental to a new family. Example: If you want to end your subscription on June 24, the cancellation must be registered no later than June 17. If the cancellation is made later than 7 days before the end date, the subscription will be automatically extended for another month.
§ 12 Product Swaps
a) Customers are entitled to request one (1) product swap within a period of twelve (12) months from the activation date of their subscription.
b) The twelve-month period begins on the date the subscription is first activated.
c) A product swap fee applies to cover administrative, warehouse, and operational costs. The applicable fee is stated on the Company’s website or can be obtained from the Customer Support team upon request.
d) The product swap can only be made for an item within the same product category and price range, where the new item’s price is no more than 10% lower than the original product’s price.
§ 13 Liability and Warranty
a) In the case of slight negligence, Parently is only liable for the violation of essential contractual obligations (cardinal obligations), meaning those obligations that the contract is intended to impose on Parently according to its content and purpose or whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the Customer regularly relies and is entitled to rely. This liability is limited to typical damages that were foreseeable at the time of the contract conclusion.
b) The personal liability of the legal representatives, agents, and employees of Parently for damages caused by them through slight negligence is also limited to the extent described in Section § 3
c) Parently is not liable in cases of unauthorized and/or illegal use of the rental and purchase items.
d) The aforementioned liability limitations do not apply in cases of intentional or grossly negligent damages, for damages caused by fault resulting in bodily harm (injury to life, body, and health), as well as for liability under the Product Liability Act and in cases of other mandatory liability provisions. Furthermore, they do not apply if and to the extent that Parently has assumed a guarantee.
e) The Customer is fully liable according to the statutory provisions.
